Auction Terms & Conditions

  1. Registration information the Bidder provides to Auctioneer shall be current, complete, and accurate. Bidders must be 18 years of age or older. All bidders must be registered in Auctioneers system. Failure to register or provide updated information may be grounds for denial of services. Buyer agrees that they are on the premises at Auctioneer’s discretion and may be required to leave at any time for any reason.
  2. Payment for purchases must be made payable to Nest Egg Auctions L.L.C., unless otherwise noted in a specific auction’s terms and conditions. Terms of sale including applicable buyer’s premium are announced at the beginning of each auction and subject to change at Auctioneer’s discretion. All sales are subject to State Sales Tax laws. Buyer must acknowledge and agree not to retract the purchase offer.
  3. No Warranty – The descriptions of items appearing in the auction and in advertising prior to this sale are believed to be correct. Nevertheless, neither those descriptions nor any oral statements made by Owner or Auctioneer concerning any item shall be construed as a warranty either express or implied. ITEMS ARE SOLD AS IS – WHERE IS.
  4. Receipt – Payment is due during or immediately following the auction. Buyer will be furnished a printed receipt upon payment.
  5. Removal Date — Merchandise becomes the full responsibility of Buyer at time of purchase, and Buyer assumes all risk of loss and damage to property until removed from sale premises. The only exception to this policy is merchandise that is temporarily held in trust by auctioneer prior to payment. Any items not removed within 14 days become property of Auctioneer and Buyer will receive no compensation for such items. Buyers may not leave unwanted items after the auction and agree to pay disposal costs in the event Auctioneer has to dispose of items Buyer purchased.
  6. Adjustments and Modifications — Errors in fact of merchandise inventory will be adjusted, but no adjustment will be made after merchandise has been removed from the premises or after the conclusion of the auction. Auctioneer reserves the right, for any reason, at its sole discretion, to terminate, change or suspend any aspect of the auction sale.
  7. Resale – Auctioneer reserves the right to resell any property not paid for in full. The Buyer shall be responsible to Auctioneer for any expenses of resale and collection and any damages resulting from the resale.
  8. Disputes between Bidders — the final highest purchaser shall be designated at the end of each auction sale / item. If a dispute arises between two or more Bidders, Auctioneers designation of the winning bidder shall be final.
  9. Injury, Damage and Indemnification — Bidder acknowledges responsibility for any personal injury or property damage caused by Bidder or his agent, and further agrees to indemnify, defend and hold Auctioneer harmless for any personal injury to himself or his agents, any property damage incurred on the sale premises, any and all claims, losses, damages, liabilities, judgments, fees and expenses related thereto, in connection with any claims arising out of, based upon, or resulting from any breach or violation by Bidder of this Contract or any use by Bidder of the auction sale or as a result of a dispute with another Bidder.
  10. Agency – Auctioneer is acting as agent for the Seller/Owner only and is not responsible for statements made by other parties.
  11. Termination: This Bidder Contract constitutes a binding agreement between Bidder and Auctioneer until terminated by Bidder or Auctioneer, which Auctioneer may do at any time, without notice, in Auctioneers sole discretion. If Bidder dissatisfaction occurs with the auction sale in any way, Bidder’s only recourse is to immediately discontinue use of the auction. Auctioneer reserves the right to terminate Bidder registration and use of the auction sale, and impose limits on certain features of the auction sale or restrict Bidder access to, or use of, part or the entire auction sale or facility without notice or penalty.
  12. Hold Harmless— Auctioneer cannot, and will not, be held responsible for any interruption in service, errors, and/or omissions, caused by any means, therefore we cannot guarantee continual, uninterrupted or error free service. Bidder acknowledges that this auction is conducted in such a manner that it relies on hardware and software that may malfunction without warning. The Auctioneer may void any sale, temporarily suspend bidding and re-sell any items that were affected by any malfunction. The decision of the Auctioneer is final.
  13. Privacy– Auctioneer gathers information for the purposes of conducting auctions. We will not sell, rent or disclose this information.
  14. Merchandise – All items are to remain as lotted. Moving items between lots is prohibited. All items are available for preview and inspection, but may not be removed from the tables, cases or general vicinity. All items must be handled with care. Any person responsible for damaging an item will be required to pay for the item in full, based on Auctioneer’s market evaluation.
  15. Check Policy: Checks are only accepted when issued by registered bidder. Auctioneer processes business and personal checks electronically. Should a check be returned, Auctioneer’s check processing service will collect any and all monies owed. Additionally, The check processing service will charge a fee to the bidder, and the bidder will be held responsible to Auctioneer for any and all fees associated with collection of said check. This fee is usually a percentage of the amount collected.
